Terms of Service

These Terms of Service govern the use of freight forwarding and logistics services provided by YOMI Ship Pty Ltd (ABN 96 699 635 311, ACN 699 635 311). By engaging our services, you agree to these terms.

1. Definitions

"Company" refers to YOMI Ship Pty Ltd. "Client" refers to any person or entity that requests or receives services from the Company. "Services" includes freight forwarding, warehousing, transport, customs brokerage, and related logistics activities.

2. Provision of Services

The Company agrees to provide the Services with due care and skill in accordance with the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (ACL). All Services are subject to the terms outlined in the specific service agreement or quote provided to the Client.

3. Client Obligations

The Client agrees to:

• Provide accurate and complete information regarding shipments and goods
• Ensure goods are properly packaged, labelled, and compliant with applicable laws
• Pay all agreed fees and charges within the specified payment terms
• Not ship prohibited, dangerous, or illegal goods without prior written disclosure

4. Limitation of Liability

To the maximum extent permitted by law, the Company's liability for any loss or damage arising from the Services is limited to the value of the Services provided. The Company is not liable for:

• Indirect, consequential, or special damages
• Loss arising from force majeure events including weather, industrial action, or regulatory changes
• Loss caused by inaccurate information provided by the Client
• Loss of profits or business interruption

Nothing in this clause excludes, restricts, or modifies any guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be excluded.

5. Intellectual Property

All intellectual property rights in the Company's systems, documentation, website content, and operational processes remain the property of YOMI Ship Pty Ltd. The Client may not reproduce, distribute, or use such intellectual property without prior written consent.

6. Pricing and Payment

All fees are quoted in Australian dollars and exclude GST unless stated otherwise. Payment terms are specified in individual quotes or service agreements. Late payments may incur interest at the rate prescribed by law.

7. Termination

Either party may terminate a service agreement by providing written notice in accordance with the terms of that agreement. The Company reserves the right to suspend or terminate Services immediately if the Client breaches these terms, including non-payment or provision of false information.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Western Australia. The parties submit to the exclusive jurisdiction of the courts of Western Australia.

9. Changes to Terms

The Company reserves the right to amend these Terms of Service at any time. Updated terms will be published on this page and take effect immediately upon posting. Continued use of our Services constitutes acceptance of any amended terms.
